Terms and Conditions for the Supply of Goods and Services through www.suddenlypublishing.co.uk

This is the User Agreement for www.suddenlypublishing.co.uk, an online shopping and booking facility operated by Suddenly Publishing Ltd, trading as Suddenly Publishing.

1. The Contract Between Us

1.1 We must receive payment of the whole price for the goods or services that you order before your order can be accepted. Once payment has been received by us, we will confirm acceptance of your order by sending an email to the address provided in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

1.2 Only adults (aged 18 or over) are entitled to enter into legally binding contracts and are therefore the only persons entitled to transact through this site. If you do not qualify, DO NOT use this site. By placing an order, you confirm that you are aged 18 years or older and capable of forming a legally binding contract.

2. Price

2.1 The prices payable for goods and services that you order are as set out on our website. Prices may be changed at any time without notice. Prices shown include VAT at the prevailing rate, where applicable.

2.2 You may be required to pay extra for delivery, handling, or booking fees, and it may not be possible for us to deliver to some locations. Our delivery and service charges are set out on our website during the checkout process and are subject to change.

2.3 All prices are displayed in British Pounds Sterling (GBP) unless otherwise stated.

3. Right for You to Cancel Your Contract

3.1 You may cancel your contract with us for goods or services at any time up to the end of the 14th day from the date you receive the goods or from the date your service purchase was confirmed. You do not need to give us a reason for cancelling your contract, nor will you have to pay any penalty.

3.2 To cancel your contract, you must notify us by email at info@suddenlypublishing.co.uk quoting your order number and details.

3.3 If you have received the goods before you cancel your contract, you must send the goods back to our contact address at your own cost and risk within 14 days of notifying us. If you cancel your contract but we have already dispatched the goods, you must not unpack them when received and must send them back to us in their original condition and packaging.

3.4 Once you have notified us that you are cancelling your contract, any sum debited to us from your payment method will be re-credited to your account as soon as possible and, in any event, within 14 days of the goods being received by us in satisfactory condition.

If you fail to return the goods or do not pay the cost of return delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

3.5 This cancellation right does not apply to:

  • Digital downloads once the download has begun;
  • Audio or video recordings, or sealed items, once unsealed;
  • Event tickets, workshops, or writing club bookings, except in cases of cancellation by us.

4. Cancellation by Us

4.1 We reserve the right to cancel the contract between us if:

  • 4.1.1 we have insufficient stock or availability to deliver the goods or services ordered;
  • 4.1.2 we do not deliver to your area;
  • 4.1.3 an event, subscription, or product becomes unavailable or is withdrawn;
  • 4.1.4 one or more of the goods or services you ordered was listed at an incorrect price due to a typographical error or an error in pricing information received by us from our suppliers.

4.2 If we do cancel your contract, we will notify you by email and re-credit any payment made by you within 14 days. We will not be obliged to offer any additional compensation for disappointment suffered.

5. Delivery of Goods and Provision of Services

5.1 We will deliver the goods or provide the services ordered by you to the address or contact details given at the time of ordering.

5.2 Delivery will be made as soon as reasonably possible after your order is accepted and, in any event, within 30 days of your order, unless otherwise agreed.

5.3 Ownership of goods passes to you upon delivery. Once delivered, goods will be held at your own risk and we will not be liable for their loss, damage, or destruction.

5.4 For digital products (including ebooks and audiobooks), delivery is completed when the digital content is made available for download or access.

5.5 If you receive a damaged, defective, or incorrect item, please email us within 7 days of delivery with your order number, description, and photographic evidence (where applicable). Upon verification, we will process your claim as soon as possible, issuing a replacement or refund within 14 days.

6. Liability

6.1 If the goods we deliver are not what you ordered, are damaged or defective, or are of incorrect quantity, we shall have no liability to you unless you notify us by email within 14 days of delivery.

6.2 If you do not receive goods ordered by you within 30 days of ordering, we shall have no liability to you unless you notify us by email within 37 days of your order date.

6.3 If you notify us of a problem within 30 days, our only obligation will be, at your option:

  • (a) to make good any shortage or non-delivery;
  • (b) to replace or repair any goods that are damaged or defective; or
  • (c) to refund you the amount paid for the goods in question.

6.4 If you contact us after 30 days, we will address your concern in accordance with the Consumer Rights Act 2015.

6.5 Save as precluded by law, we shall not be liable for any indirect or consequential loss, damage, or expense (including loss of profits, business, or goodwill) arising from any problem notified under this clause.

6.6 You must observe and comply with all applicable laws, including customs and import regulations, for goods purchased from our site. We make no representation or acceptance of liability regarding the import or export of our products.

6.7 Nothing in these Terms limits our liability for death or personal injury caused by negligence or for any other liability that cannot be excluded under UK law.

7. Event Tickets, Subscriptions, and Memberships

7.1 Event tickets and workshop bookings are non-refundable unless cancelled by us.

7.2 We reserve the right to alter event details, times, venues, or speakers. If an event is cancelled or substantially altered by Suddenly Publishing, ticket holders will be entitled to a full refund or transfer to an alternative event.

7.3 Subscription services (including book boxes, memberships, or writing clubs) are billed according to the plan selected at checkout. You may cancel at any time before the next billing cycle. Refunds will not be issued for partially used periods unless required by law.

7.4 Digital or membership-based services may require a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

8. Notices

Unless otherwise stated in these Terms, all notices from you to us must be in writing and sent by email to info@suddenlypublishing.co.uk.

All notices from us to you will be displayed on our website or sent to the email address you provided.

9. Events Beyond Our Control

We shall have no liability for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including (without limitation): strikes, lock-outs, industrial disputes, breakdown of systems, network access failure, pandemic, flood, fire, explosion, or accident.

10. Invalidity

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue to apply in full.

11. Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy, which forms part of these Terms and Conditions and governs how we handle personal data in accordance with the UK GDPR and Data Protection Act 2018.

12. Third Party Rights

Except for our affiliates, directors, employees, or representatives, a person who is not a party to this agreement has no rights under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This does not affect any right or remedy available apart from that Act.

13. Governing Law

Each transaction is deemed to be completed within the United Kingdom and shall be governed by and interpreted in accordance with English law. Any dispute or claim arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Entire Agreement

14.1 These Terms and Conditions, together with our current website prices, delivery details, contact information, and privacy policy, set out the entire agreement relating to the supply of goods and services to you by us.

14.2 Nothing said by any employee or representative of Suddenly Publishing should be understood as a variation of these Terms, nor as an authorised representation of the nature or quality of any goods or services offered. We accept no liability for any such representation being untrue or misleading.

14.3 We make no representations or warranties regarding the accuracy, completeness, or suitability for any purpose of the information published on our website. Technical inaccuracies or typographical errors may occur. All liability for such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

14.4 Nothing in these Terms is intended to limit any rights you may have as a consumer under applicable UK law, nor to exclude or limit our liability for death or personal injury resulting from our negligence.

15. Trademarks

Suddenly Publishing Ltd is the operator of the Suddenly Publishing trademark, branding, and associated get-up. All other trademarks, product names, and company names or logos cited herein are the property of their respective owners. No permission is granted by Suddenly Publishing Ltd in respect of the use of any such brand names, titles, or copyrights, and such use may constitute infringement of the owners’ rights.
